Court grants 7 day police remand in Ban terror attack

JAMMU, Feb 1: In much publicized Ban Toll Plaza terrorist attack yesterday in which 3 Pak militants of JeM outfit were gunned down while 3 Pulwama Over Ground Workers (OGWs) were also arrested, police today produced three OGWs namely Sartaj Ahmed Mantoo S/O Firdous Ahmed Mantoo R/O Kisrigam Tehsil Kakapura District Pulwama, Asif Ahmed Malik S/o Bashir Ahmed Malik R/O Qaziqund Tehsil Kakapura District Pulwama and Sameer Ahmed Dar S/O Abdul Rashid R/o Kisrigam Tehsil Kakapura District Pulwama before Special Court for seeking remand.
Special Judge NIA Subash Gupta granted seven days police remand of Sartaj Ahmed Mantoo, Asif Ahmed Malik and Sameer Ahmed Dar.
Today when they were produced before the Court, APP Sanjay Kohli filed an application seeking remand of 10 days, Court carefully gone through the CD file and the present application and after perusal of the CD file reveals that the above named accused were arrested on 31.01.2020 in the above titled case for the commission of offences 307/120-B/121/122/123/IPC, 7/25/26/27 Indian Arms Act, 16/18/ULA Act. It is further revealed from the CD file that investigation of the case is in progress and it will take some time to conclude.
Keeping In view the nature of the case, Court observed that the stage of investigation, submissions made by the IO of the case and the gravity of offences involved in the present matter, Court is satisfied that police remand of the accused is imperative. Therefore in view of the submissions made in the application, the accused are remanded to police custody for a period of seven days. Accused persons be provided medical facilities, while they are in police custody during the currency of remand period. They are apprised of their right to engage counsel. --(JNF)
