After lapse of two and half months, Law Commission recommendations on amendment in SRO-202 gather dust | | | Early Times Report
Jammu, Feb 1: The recommendations, of Law Commission for making amendments in SRO-202, also called the new job policy, have reportedly been gathering dust as no action has been taken by government after the lapse of over two and half months. The Law Commission of Jammu and Kashmir headed by retired Justice MK Hanjura had taken suo-moto cognizance of the SRO-202 and had submitted his recommendations to the Chief Secretary for making amendments in the SRO. The recommendations were submitted by Law Commission in mid of November 2010 and it was recommended for reduction of probation period of employees engaged under new job policy (SRO-202) from five years to two years. It had also recommended that the government employees, who have completed two years of probation on the date of the promulgation of Jammu and Kashmir Reorganization Act 2019, may be regularized subject to the conditions laid down in the SRO. After the lapse of over two and half months since the recommendations were submitted, no action has been taken so far by the government, evoking anger and criticism among the newly engaged employees, who had pinned high hopes on BJP led government that SRO-202 would automatically done away with, as it was formulated under J&K’s constitution, which ceased to exist. But their hopes were dashed to ground when the UT administration had protected the SRO-202 after which Law Commission had taken suo-moto cognizance and had made recommendations to amend SRO-202. An official of General Administration Department (GAD) pleading anonymity said that no action has been taken on the recommendations and the recommendations were not mandatory for the government. Employees engaged under SRO-202, pleading anonymity said that it was totally unfortunate that the recruitment rules framed under JK constitution, which were against the interests of the employees was protected. “More worrisome is the attitude of the Lieutenant Governor led administration which is not considering the recommendations of its own Law Commission”, the employees said, adding that the incumbent dispensation is seemingly following the footsteps of previous governments.
