Court awards 12 years RI to Army man in minor’s rape case

JAMMU, Feb 28 : Principal Sessions Judge Rajouri Jaffer Hussain Beigh today awarded 12 years rigorous imprisonment to an Army man Ravinder Kumar alias Sonu, son of Rattan Singh of Kalsian Tehsil Nowshera District Rajouri who was facing trial in rape and kidnapping with minor.
Principal Sessions Judge Rajouri Jaffer Hussain Beigh after hearing both the sides observed that the imposition of sentence upon the accused is concerned, the nature of the offence, the circumstances of its commission, the age and the character of the offender, injury to individual or the society, effect of the punishment on the offender, eye to correction and reformation of the offender, are some amongst many other factors which would be ordinarily taken into consideration by the Court. The main offence under section 376(1) RPC committed by the accused is punishable with imprisonment of either description for a term which shall not be less then seven years but which may be for life or for a term which may extend to ten years, and shall also be liable to fine. The trial in this case has taken more than a decade and the accused is army person and has his own family For these reasons I sentence accused, namely, Ravinder Kumar alias Sonu to undergo rigorous imprisonment for seven years and to pay a fine of Rs.10,000/- and in default of payment of fine he shall further undergo imprisonment of like nature for 6 months for the commission of offence under section 376(1) RPC, also to undergo rigorous imprisonment for five year and to pay a fine of Rs.7000/- and in default of payment of fine he shall further undergo imprisonment of like nature for six months for the commission of offence under section 363 RPC. Both the sentences of rigorous imprisonment shall run concurrently. JNF
