Early Times Report

Jammu, Mar 5: The Jammu and Kashmir High court has stayed the selection for the post of clinical staff for casualty bed (Health and medical Education Department Doda), for divisional care Jammu’.
As per the details available with Early Times, the writ petition bearing WP(C) No.715 /2020 titled Mohsin Nisar Doolwal vs Union Territory of Jammu and Kashmir and others through Commissioner Secretary Health and Medical Education was filed by Mohsin Nisar Doolwal son of Nisar Ahmed Doolwal Resident of Mohallah Noorabad, Tehsil and District Kishtwar through his counsel Advocate N.D Qazi wherein the petitioner challenged the selection of aforementioned post on the ground that petitioner is more meritorious than the selected candidate and possess higher qualification as compared to those who were selected.
The counsel for the petitioner submitted that the qualification prescribed in the advertisement notification is the minimum and the petitioner possessing higher qualification cannot be held to be ineligible.
Justice Ali Mohammad Magrey after hearing the arguments of the counsel for petitioner stayed the operation of impugned select list.
“Prima facie a case for grant of ad-interim relief is made out. Notice returnable within four weeks. Steps for service within one week” read the court order and list the case for 18-4-2020 for next date of hearing,” the judge ruled.
