Man gets life imprisonment for murder

Jammu, Aug 18: Principal Sessions Judge Rajouri Jaffer Hussain Beigh has awarded rigorous life-impriosnment to Sat Paul S/O Dhani Ram R/O Draj Mohra, Kotranka who was involved in murder of Shafiq Ahmed over a land dispute.
On 27-08-2010 a police case was filed at Police Station Budhal against Sat Paul, Krishan Lal, Parshotam Lal sons of Dhani Ram and also against Dhani Ram, Dev Raj, Diya Ram sons of Balak Ram with averment therein that the accused persons were having enmity with him on a piece of land. In the previous year, in order to snatch such land from him, the accused persons instigated a lady against them due to which huge loss was caused to him by engaging him in litigation in the court and before the police. On this enmity, the accused No.1 after hatching conspiracy with other accused persons on 27-08-2010 at 6 .00 am armed with VDC gun trespassed into his house and triggered the gun at the chest of his son Abdul Latief but the fire was missed and his son had a narrow escape. The accused No 1 than came out of the house of the complainant and fired the gun shot upon his elder son Shafiq Ahmed in the Verandah and committed his murder. On this report FIR No 76/2010 for offences U/S 302/452/109 RPC ad 4/25 Indian Arms Act was registered with which Police swung into action, went on spot, arrested accused Sat Paul who after committing the murder of the deceased was kept in a room by the legal heirs of the deceased. Site plan of the place of occurrence was prepared; the dead body of the deceased was taken into custody. Simple clay and blood stained clay were seized and sealed by Mark ‘F’ The complainant produced the weapon of offence VDC Rifle 303 bearing butt no 222/ R and body No. 37062-L and 3 live cartridge of 303 which were seized and sealed. An empty cartridge was also recovered from the spot which was seized and sealed with Mark ‘F’. The site plan for place of recovery was also prepared. Post mortem of the dead body was conducted. The Medical Officer produced the blood stained clothes of the deceased and a purse and also Rs. 400 consisting of eight currency notes of Rs 50 which were also seized. Clothes of the deceased were packed and sealed. Executive Magistrate resealed the packets produced by the Police and sent them to FSL Jammu. The dead body of the deceased was handed over to the legal heir of the deceased for last rites.
Principal Sessions Judge Rajouri Jaffer Hussain Beigh after hearing both the sides observed that the case does not fall within the category of ‘rarest of rare case’. I, accordingly, sentence the accused Sat Paul to undergo rigorous imprisonment for life and also to pay a fine of Rs.10,000/- for the commission of offence under section 302 RPC and in default of payment of fine he shall further undergo imprisonment of like nature for two years. As death penalty has not been imposed under section 302RPC, for this reason, the accused is also sentenced to undergo rigorous imprisonment for five years and also to pay a fine of Rs.4000/- for the commission of offence under section 449 RPC and in default of payment of fine he shall further undergo imprisonment of like nature for six months and further, he is also sentenced to undergo rigorous imprisonment for two years and also to pay a fine of Rs.5000/- for the commission of offence under section u/s 3(1) read with section 25(1-B)(a) Arms Act and in default of payment of fine he shall further undergo imprisonment of like nature for two months. The sentences imposed upon the accused shall run concurrently. The accused be lodged at Central Jail Kote Bhalwal Jammu for undergoing the above said sentences imposed upon him. JNF
