Court directs enquiry into alleged death of woman by medical negligence | | | Early Times Report JAMMU, Mar 17: JAMMU, Mar 17: Pawan Sharma Sub-Judge Jammu directed SHO Police Station Gandhi Nagar Jammu to hold enquiry into the alleged death of a woman by medical negligence. Court has directed the police to complete the enquiry within 15 days. A K Sawhney (Advocate) filed the complaint against doctors namely Narinder Mohan, Kamal Gandotra and Gulab Singh, Asiya, Ram, Subash, Hem Raj & others of the Madaan Hospital and Research Centre Gandhi Nagar Jammu and other accused of JK Medicity Hospital, Bye Pass Jammu and its team alleging that daughter of Anil alias Neel was admitted to a private hospital Gandhi Nagar Jammu. The lady was pregnant and was taken to OT where doctors' team committed negligence in conducting the case including giving anesthesia. Anesthesia was given to her where she died as per the allegations leveled by the complainant and sister of the victim. The Court observed that the concerned police authorities have not acted in a manner as directed by Hon'ble Supreme Court of India in LalitaKumari Vs State of U.P and Priyanka Shrivastav judgment. It is not an ordinary situation in which this court can come to conclusion that there is a prima facie case against the accused, but it is also not a case where the court can close its eyes and say there is no case to be looked into. The Court observed that it is a case where in a preliminary enquiry is to be carried out, to verify the veracity of the allegations of negligence, if any, against any of the accused, as well as, to find whether a cognizable offence is disclosed or not. If information as to cognizable offence is disclosed then SHO P/S Gandhi Nagar Jammu shall register an FIR against relevant provisions of law and thereafter proceed in accordance with law. |
