NHRC takes note of delay in compensation to NoK, gives six weeks to pay

JAMMU, May 14: Taking cognizance of the undue delay in paying compensation to the Next of Kin (NoK) of the infants died due to consumption of spurious drugs in Ramnagar area of Udhampur district, the National Human Rights Commission (NHRC) has directed the J&K government to make payments within six weeks.
Despite desperate attempts by the Union Territory of Jammu & Kashmir to stonewall the orders of the National Human Rights Commission (NHRC) and the J&K High Court to pay monetary compensation to the next of kin of infants, the NHRC vide its proceedings dated May 6, 2021 has again rejected the recent attempt of the administration to delay the matter.
Sukesh C Khajuria, a social activist of Jammu, had taken up cudgels on behalf of the innocent child victims of spurious drugs with the authorities of various states and filed a petition/complaint in the NHRC seeking action against erring drug control officials and compensation to aggrieved families who have lost their children.
The NHRC in its fresh order stated that the recent proceeding shall be read in continuation to the proceeding dated 18.01.2021 and directed the Chief Secretary, Govt. of Jammu & Kashmir to pay monetary compensation of Rs 3, 00,000 to the NoK of each deceased in the present case within six weeks and submit compliance report within this period failing which the Commission will be constrained to invoke its coercive power u/s 13 of the PHR Act, 1993 calling for the personal appearance of the authority concerned before the Commission.
The NHRC directed its Registry to transmit copy of last direction dated 18.1.2021 along with this direction and also requested that the additional/complete report as directed by the Commission in the matter be sent latest by 27/06/2021, for further consideration by the Commission.
Sukesh C Khajuria said that while on one hand, the J&K administration has been trying to delay the proceedings; on the other hand it has been preparing to go to Supreme Court challenging the order of the J&K High Court. He said that it was really sad that the J&K government as well as Union government which claim to be guardian of democracy and common people is trying to evade not only their responsibility but not willing to give a pittance as compensation to poor parents of infant victims. He said that these shameless governments are spending crores on political bigwigs and bureaucracy. “This attitude is deplorable,” he added.
