Court frames charges against 7 underground workers of HM
Passes strictures against IO, directs to conduct departmental inquiry

JAMMU, June 8: In a much publicized arrest of underground works of HM in Kishtwar, 3rd Additional Sessions Judge Jammu Sunit Gupta farmed charges against seven accused while three were discharged from the offences.
The charges were framed against Bashir Ahmed, S/O Lal Din, Wali Mohd, Ghulam Nabi, Mohd Ramzan and Saddam Hussain were ordered to be charged for the offences U/Ss 13/19/39 UA(P) Act. The accused persons Khazar Mohd was charged for the offence under sections 13/23 UA(P) Act and 3/25 Arms Act . The accused Mohd Hassan was ordered to be charged for the offences U/Ss 13/18/19/23/39UA(P) Act and 3/25 Arms Act whereas discharged the accused namely Zahoor Ahmed, Bashir Ahmed S/O Abdul Gani Sheikh and Yassir Hussain.
3rd Additional Sessions Judge Jammu (Special Judge under section 22 of NIA ACT) also passes strictures against DySP Sunny Gupta and directed for departmental inquiry.
Brief facts of the present case are to the effect that on 2nd January 2020, SHO Police Station Dachhan had received information from reliable sources that some of the persons are working as underground workers for the terrorist organization HM and they used to provide all kinds of logical support to the categorized militants of HM Terrorist Organization. It is also reported that these persons used to provide hideouts and harbour the categorized militants within the jurisdiction of the said police station and they also used to give logistic support for shifting those militants from one place to another. It was also informed that the aforesaid persons were continuously attending the meetings with the active militants of HM Terrorist Organization namely Mohd Amin @ Jahangir Sarori S/O Mohd Gaffoor Bhat R/O Saroor, Mudassir Ahmed S/O Tariq Hussain R/O Tinda Dachhan and Riaz Ahmed S/O Mohd Ramzan R/O Rataki Madoora and they used to supply requisite information to the active categorized militants.
On the conclusion of the investigation, the IO has claimed to have proved that the aforesaid accused persons were used to harbour and provide logical support to the active terrorist of HM and they also used to provide all the facilities to shift the aforesaid categorized militants from one place to another. They were also providing the financial assistance to the aforesaid active terrorists for the terrorists activities in the nearby areas, so that an atmosphere of terror be created in the area. As per the investigation, the offences under sections 13/18/19/39 UA(P) Act were found to have been proved against the accused persons
While discharging/ framing of charges, 3rd Additional Sessions Judge Jammu (Special Judge under section 22 of NIA ACT) Sunit Gupta observed that before parting away, I would like to register my reservations and dissatisfaction against the investigating officer of the present case, who appeared to have conducted the investigation in the present case in very perfunctory and unprofessional manner. The quality of the investigation does nowhere speaks about the fact that the investigation in the present case has been conducted by a Gazetted officer with the rank of Dy SP of police department. From the perusal of the file, it reveals that initially at the time of registration of the FIR, number of persons have been roped in the present case but during the investigation, the Investigating Officer Sunny Gupta, DySP (HQ) Kishtwar has conducted the investigation in such a lethargic and sluggish manner that he had not taken even a little pain to search for the evidence in the present case.
These kind of sensitive cases which are connected with the sovereignty and unity of the nation have been assigned to such Senior Police officers with the Rank of DySP and above so that a better investigation can be expected from them. But when we look into the investigation in the present case, we find that a much better investigation could be conducted by even a Head Constable in comparison to the investigation conducted in the present case by Sunny Gupta, DySP. Therefore, Inspector General of Police, Jammu Zone is hereby directed to conduct a departmental enquiry against the aforesaid delinquent police officer namely Sunny Gupta, DySP who has not done his job in an honest and able manner. Office is directed to communicate this order to IGP, Jammu through APP of this court for its compliance. JNF
