On Wednesday, the counsel of the accused moved a bail application in the Court of Chief Judicial Magistrate Anantnag. The Court had sought a report from the Station House Officer Police Station Anantnag.
In 2019, the Anantnag Court had also granted anticipatory bail and directed him join the investigation when required and not to leave territorial limits of Jammu and Kashmir without the permission of the court, however he didn’t cooperate with the police investigation. A senior Police officer, who heads the SIT, informed the Court that the accused wasn’t cooperating and joining the investigations. Important to recall, Deputy Inspector General of Police (DIG) South Kashmir Range had filed a written complaint to Police Station Anantnag stating Ajay Kumar Agarwal was instituting fake complaints against some people residing outside Jammu and Kashmir to extort money from them.
In his letter-CRB/SKR/10399-10400 dated 13-05-2019- DIG South Kashmir stated that he has learnt from reliable sources that an office under the name of Host and Finance is being run at K P Road Anantnag by Ajay Kumar Agarwal, who is involved in instituting fake complaints in different courts of Anantnag and Kulgam against some persons residing outside the state of Jammu and Kashmir. "He has established an offence and exploits his employees as a front for filling these false complaints," reads the letter.
DIG in his letter says that on the basis of fake complaints, the accused was obtaining non-bailable warrants and was later using them for extracting money from his 'targets'.
On the basis of DIG South Kashmir, Anantnag Police has registered a case against the accused U/S 420, 467, 468 PRC and SIT was constituted to probe the matter.
Police in its initial report said that they have raided the office of the accused and seized two laptops, documents and different kinds of seals.
The accused had set up an office in Anantnag and employed few boys and girls. All those employees have confessed before the police that the accused persons were directing them to file complaints in different courts against non-local businessmen. They said on the basis of those complaints, the accused were obtaining non-bailable warrants and later he was using these warrants and his gang of lawyers for extortion.
According to an investigation conducted by Police and the statements of witnesses, it was Ajay Kumar Agarwal who introduced Pankaj Jain to his staff in Anantnag. Ajay was running a company however on Pankaj’s direction, the office was renamed as Host and Finance Pvt Ltd and on behest of Ajay, Pankaj directed his staff to file fake complaints against victims.
On such compliant was registered against Vikram Baderwaj who owned Top Line Built Pvt Ltd and fake arrest warrant was secured a fake arrest non-bailable warrant against him
Two persons Vikram Baderwaj, a resident of New Delhi and Alok Kumar, resident Mayoor Vihar Delhi attended the office of In-charge SIT and stated that on 19-01-2019, a police party from Kashmir visited the house of Vikram Baderwaj and produced a non-bailable warrant which was issued by Judicial Magistrate 1st class Qazigund. The police party arrested Baderwaj and took him to New Delhi's SafdarJung Police Station; however later released him as they suspected that the warrant was issued in fraud and frivolous case, reads police report.
Ajay Kumar Agarwal and Pankaj Jain had also filed fake complaints against innocent businessmen of the country and were extorting money from them. While Ajay Kumar Agarwal was arrested and granted bail on June 13, 2019 by the Anantnag court, his accomplice Pankaj Jai was arrested after two years and was put behind bars.
