HC directs contemners to file fresh compliance report in contempt petition

Jammu, Aug 6: In a contempt petition which has been filed by the petitioner aggrieved of the Non compliance of the writ court order court of Justice Sindhu Sharma directed the counsel for the contemnors to file compliance report on next date of hearing in a contempt petition having titled “Kartar Singh VS Sanjeev Verma and ors.
When the matter came for hearing, counsel for the petitioner Mohd irfan submitted before the court that six year down the line since the writ court disposed of my petition and directed the Contemors to access the compensation and pass the award qua the portion of the land actually used for the construction of the road to the extent of its involvement of the aforesaid survey no. 126 situated at Moza Digiana but till now nothing has been done which speaks of contemptuous attitude of these Government Officers who are contemnors having no regard for the sanctity of the court orders.
Counsel Mohd irfan vociferously argued that petitioner is bed ridden suffering from Multiple ailments and is in dire need of the money as his land has been taken by the P. W. D (R&B) department but they are not paying me the compensation and in the year 2018 filed the contempt petition of the writ court order as being aggrieved order not implemented in its letter and spirit.
Justice Sindhu sharma after perusing the record put a specific query to the petitioner counsel ,whether the other side file a statements of facts then the counsel replied yes they have filed, Justice Sindhu asked what they said in the statement of facts counsel replied they Just send a communication letters to the revenue department and adopting dilly dallying tactics nothing else and in the statement of facts they mentioned that from Tehsildar they sought the report but the report not disclosed how much land has been utilized by the P. W. D for the construction of the road.
After considering the submissions of both sides, The court of Justice Sindhu Sharma direct the contemnors to file compliance report on next date of hearing and kept for 10th of September 2021.
