Allegations of land grabbing, property dealing against police personnel | HC directs SSP Samba, SHO P/S Vijaypur to file status of FIR | | Early Times Report JAMMU, Dec 15: In a significant order Justice Sindhu Sharma of High Court of Jammu & Kashmir and Ladakh (Jammu wing) has directed Senior Superintendent of Police, Samba and SHO Police Station, Vijaypur to file status report before the next date of hearing with regard to investigation in FIR 0005/2019 dated January 6, 2019 registered with Police Station, Vijaypur under Sections 379/447/427/504/506 RPC against Ajay Singh, Inspector J&K Police presently posted at GRP Railway Station, Jammu and Rajinder Singh Head Constable presently posted at Police Line, Kathua. The Court also issued notices to the Principal Secretary (Home) J&K Government, Director General of Police J&K, Inspector General of Police Jammu Zone Jammu, Deputy Commissioner Samba, Senior Superintendent of Police Samba, Tehsildar Vijaypur, SHO Police Station Vijaypur, Ajay Singh-Inspector J&K Police and Rajinder Singh-Head Constable J&K Police returnable within four weeks. These Court directions were passed in a writ petition filed by Ranjit Singh son of Lehar Singh resident of Rahya, Tehsil Vijaypur District Samba seeking a direction to the Director General of Police, J&K and Inspector General of Police, Jammu Zone, Jammu to constitute a Special Investigation Team (SIT) to be headed by an IPS Officer having impeccable integrity so that the investigation in the FIR is conducted fairly/impartially without any political intervention. It has been submitted that the petitioner is a retired Master from School Education Department and is the owner in possession of land measuring 15 Kanals 5 Marlas falling under Khasra No.1466 and 15 Kanals 02 Marlas in Khasra No.1466 min jointly with co-sharer Goverdhan Singh situated at Bagla, Rahya), Vijaypur. It was submitted that on April, 4, 2017 Sub-Inspector Ajay Singh then posted as Line Officer at DPL Jammu and Head Constable Rajinder Singh trespassed into the land of the petitioner and forcibly demolished the iron gate installed on the said land. The whole incident has been photo-graphed and video-graphed and both the police personnel tried to grab the land of the petitioner and both of them have been caught on camera. It was submitted that both the police personnel are involved in land deals and the local police has been extending full cooperation to the duo in view of their political patronage. It was submitted that the Vijaypur Police Station did not register the FIR against the police personnel as prime accused Ajay Singh happens to be the brother-in-law of then Deputy Chief Minister Dr. Nirmal Singh and it was on the intervention of the Chief Judicial Magistrate, Samba under Section 156(3) Cr PC FIR 0005/2019 dated January 6, 2019 came to be registered against the influential accused after the passage of several months. It was submitted that there is no headway in the investigation as the local police is under the influence of prime accused who is a real brother-in-law of Dr. Nirmal. It was submitted that the investigating officer and the field revenue staff are just exchanging letters for the demarcation of the subject land and the petitioner has completely lost hope/confidence in the ongoing investigation by the local police. It was submitted that the political patronage of prime accused can be ascertained from the fact that despite lodging of FIR, Ajay Singh has been promoted to the next higher rank of Inspector. He further submitted that no departmental action was initiated by the higher authorities under Police Manual against both the accused in view of their access in the corridors of power. Justice Sindhu directed Senior Superintendent of Police, Samba and SHO Police Station, Vijaypur to file status report before the next date of hearing with regard to investigation in the FIR. |
