Palm Island Mall investors accuse promoters of cheating

JAMMU, May 6: As many as 217 investors of Palm Island Mall have accused the promoters Amarnath Choudhary and Radhey Shyam Choudhary of harassment and cheating through their unscrupulous actions.
The investors alleged that Amarnath Choudhary and Radhey Shyam Choudhary, promoters & landowners of Palm Island Mall, are renowned litigants who have been cheating various government departments and harassing the public by manipulating, cheating and committing fraud with the society at large.
For more than a year now, they have conspired to keep Palm Island Mall, Canal Road, completely shut, forcing 217 property owners and tenants to close their running businesses which have also affected the livelihood of 10,000+ local staff who were employed directly and indirectly in the Mall, they said.
The investors further alleged that the primary reason behind the Mall being shut is the huge outstanding electricity dues with JPDCL of Rs 1.26 Crore, on the private name of Amar Nath Choudhary (landowner), despite them collecting electricity dues from individual constituents of the Mall and not depositing it with JPDCL thus cheating the clients and misappropriating these funds, as a result the electricity department has issued notice for disconnection of the electricity to the Palm Island Mall complex.
The same Amarnath Choudhary has a pre-existing electricity default of Rs 1.27 Crore at Royal Palm Apartments (Akhnoor Road), again on his private name thus willfully causing the state exchequer a loss of close to Rs 2.5 Crores, without any consequences for him or the other electricity connections on his private name.
The problems began back in 2010, when Amarnath Choudhary and Radhey Shyam Choudhary in collaboration with Ridhi Sidhi Infra Projects Pvt Ltd (Developer), agreed to develop and sell a commercial mall complex by the name of Palm Island Mall, but due to the malafide intentions and obstructive actions of Amarnath Choudhary and Radhey Shyam Choudhary, the construction and subsequent possession of the Mall shops to the investors finally happened in 2019, an inexplicable delay of 5 years, which has not been compensated to the clients till date.
Furthermore, despite the J&K High Court’s interventions and directions to Amarnath Choudhary and Radhey Shyam Choudhary to complete registration of conveyance deeds of the investors, he continues to put hurdles and harasses the poor investors who have paid full amount as per the Sale Agreement but are now running pillar to post to take possession of their own properties and register their conveyance deed who are unable to start commercial activity in their Mall space for almost 10 years now.
As a result, the investors are compelled by the circumstances to resort to ‘hunger strike’ against the ongoing fraud and cheating practices and actions of Amarnath Choudhary and Radhey Shyam Choudhary. The Palm Island Mall Association, demand the immediate arrest of Amarnath Choudhary and Radhey Shyam Choudhary and trial under law for their malafide intentions and unscrupulous actions.
The Palm Island Mall Association would also like to highlight that most of the Land owned by Amarnath Choudhary and Radhey Shyam Choudhary is illegally occupied by fraudulent manipulations and corrupt actions and the validity of their ownership needs to be investigated. The association also appeals to the Lieutenant Governor of UT of J&K that corrective action against these perpetual cheaters and defaulters is initiated by all relevant departments in order to provide justice to investors to restore faith in the rule of law.
