| SMC allows construction of illegal malls on road to new court complex | | R&B cautions, admin sleeps | | Early Times Report
Srinagar, Nov 27: Taking corruption to new heights, the Srinagar Municipal Corporation (SMC) has been allowing construction of around one dozen illegal shopping malls on main road leading to the new court complex at Mominabad here, official sources said.
They said ahead of the inauguration of the lower Court complex near the highway, some builders were eying to construct shopping malls illegally on this road where commercial constructions are otherwise banned. Some concerned citizens have decided to move High Court over Master Plan violations.
Whereas in the past four months of unrest in Kashmir around ten shopping malls have been coming up illegally on the Mominanbad road, in the latest, six shopping complexes are coming up in the area.
Sources said the Chief Engineer Roads and Building department in the past few months served multiple notices to the SMC to get the constructions demolished but the civic body remained silent.
"We had told them that the buildings are violating of the Ribbon Development Act and that road widening on this road would be impossible in future," said an R&B official, pleading anonymity. Officials said R&B had informed the SMC that the biggest violation ever was that one shopping complex was coming up right outside the main gate of the Court complex and that it "could lead to congestion on his road where prominent jurists are expected to travel in the coming months when the Court complex is commissioned." Lower Court Srinagar operates from a makeshift arrangement in Bemina locality since September 2014, when the old court complex at Lal Chowk was damaged in floods.
While the government is working hard to get the new court complex at Mominabad commissioned at an earliest, the SMC has allegedly doubled its "hafta" to facilitate illegal constructions on this road. Officials said last month a delegation of lawyers had called on the enforcement wing of the SMC seeking demolition of illegal constructions. "But the SMC declined to take action as millions of rupees are at stake in these constructions," the sources said. Illegal constructions have grown manifold, during the unrest. Forget any demolition, the sources said the SMC has even not identified the illegal structures on this road.
"Not a single illegal construction which is underway or has been completed on this prestigious road has been disclosed in the list of illegal constructions as desired by the Housing minister, otherwise this all is visible right from the end of Batamaloo bus stand where a mall has been constructed illegally with old windows so that the construction looks to be old," said an SMC official pleading anonymity.
When contacted a senior SMC official said "basically the problem is that we don't have a full fledged Commissioner, and unless that is achieved, the problem will persist."
Meanwhile a group of lawyers have decided to apprize the High Court about the major Master Plan violations, which are being allowed in the city by the SMC and other enforcement authorities. "We are preparing a detailed report for submission before the honorable High Court," the lawyers told Early Times. |
