DC Kishtwar fails to dispose of RTI appeal | Info about Annual action plan of Irrigation Deptt | | Early Times Report Jammu, Feb 5: The Deputy Commissioner Kishtwar who is also the First Appellate Authority (FAA) under J&K RTI Act 2009 has been caught on the wrong foot for his failure to dispose off an appeal after the applicant was earlier denied information by the Chief Planning Officer (CPO). As per details available one Raj Kumar S/o Mohan Lal R/o Village Keshwan, Naresh Kumar S/o Som Nath R/o Village Keshwan, moved an application dated 06- 08-2014 before the Chief Planning Officer (CPO) , Kishtwar under J&K Right to Information Act, 2009 where-under they sought certain information about the details of estimates and Annual Action Plan received under different heads of Irrigation and Flood Control Division, Kishtwar. The Chief Planning Officer, Kishtwar vide office letter no. DDCK /Plg /RTI Act (11 12)/12/316/2386-87 dated 09-08-2014 furnished the requisite information comprising of 12 leaves to the applicants. However, the applicants were not satisfied with the information provided to them preferred 1st appeal dated 09-09- 2014 before the Deputy Commissioner/First Appellate Authority (FAA) Kishtwar. The record as per SIC order shows that the 1st appeal was not been adjudicated and disposed of by the Deputy Commissioner Kishtwar who is also the First Appellate Authority (FAA) . "The 1st Appellate Authority being a quasi judicial authority is hereby reminded of its duty under the J&K RTI Act, 2009 that it should dispose of appeals within the statutory period as prescribed under the J&K RTI Act, 2009 after observing the principles of natural justice and providing an adequate opportunity of being heard to the parties. In this case, the appellants have not been heard and the appeal has also not been adjudicated by the FAA" reads the SIC order. Feeling aggrieved of inaction on the part of the Deputy Commissioner Kishtwar the First Appellate Authority (FAA), the appellants preferred 2ndappeal dated 08-12-2014 before the State Information Commission (SIC) wherein he alleged that the PIO has provided incomplete information which is not as per the RTI application. The Commission after receiving the 2nd appeal listed the matter for hearing on 16-01-2015 and the parties were present. During the course of proceedings at SIC office on 16.1.2015 the Chief Planning Officer, Kishtwar informed the Commission that whatever information was available in his office has been dispatched to the appellants vide office letter no. DDCK/Plg/2015/4653-55 dated 05-01-2015 and a copy the same has also been endorsed to the Commission. However, the appellant Raj Kumar denied the receipt of the same. The CPO, Kishtwar furnished a set of information to the appellant during the course of proceedings. During the hearing the CPO, Kishtwar further assured the Commission that he would provide the revised information to the information seekers and they are at liberty to inspect the records in his office. While issuing order against the CPO Kishtwar the Information Commissioner Dr S K Sharma directed the CPO to furnish the revised information to the information seeker free of cost within 7 days from the date of receipt of the SIC's order under an intimation to the State Information Commission (SIC) . The CPO, Kishtwar was further directed to allow the appellants an opportunity to inspect the record and provide them certified copies of the relevant documents free of cost if any, requested by the information seekers. |
