Forging of DOB: Court acquits ASI following prosecution failure 2/21/2015 11:20:24 PM Early Times Report Jammu, Feb 21 (JNF): Chief Judicial Magistrate (CJM) Jammu today acquitted one Goverdhan Singh then ASI facing trial for alleged forging of his Date of Birth (DOB) from 27/07/1944 to 27/07/1949, as prosecution agency Crime Branch failed to prove its case. Chief Judicial Magistrate (CJM) Jammu SC Katal acquitted one Goverdhan Singh then ASI against whom Crime Branch has registered an FIR u/s 420/468/471 RPC that he has forged his Date of Birth and the prosecution agency i.e. the Crime Branch failed to prove its case. CJM Jammu SC Katal after hearing both sides observed that it is the duty of the prosecution to prove their case beyond shadow of doubt and as no evidence is available in record to prove that accused collected the school leaving certificate, temper and hence benefit of doubt goes to accused person and acquitted the accused from the charges. According to the police case that Crime Branch has received a letter from IGP regarding mutilation in date of birth entry by ASI Goverdhan Singh.
