Six yrs RI, fine Rs 50,000 awarded to accused | | | Early Times Report
Jammu, May 29: Principal Sessions Judge Bhaderwah today awarded six years RI and fine Rs 50,000 u/s 304-ii (culpable to homicide not amounting to murder) to one Abdul Qayoom Ganai who was facing trial in killing of one Abdul Majid for last more than nine years. Meanwhile court also directed State to pay compensation of Rs two Lakhs just and reasonable amount for providing financial assistance to the family of victim which shall be paid within one month by the State Government. After hearing hearing Sr Adv MA Goni and Adv NK Gupta for the accused whereas Public Prosecutor for the State, the Principal Sessions Judge Bhaderwah Sanjeev Gupta awarded six years RI and fine Rs 50,000 to the accused. While awarding sentence, Court also observed that besides the imposition of aforesaid fine amount on the convict, the family of the victim is also entitled for compensation under Jammu & Kashmir "Victim compensation Scheme" Sub Section I of S 545 of CRPC has been made applicable to the state of J&K vide Notification dated 23/04/2013 under SRO 229 and as per schedule to the Notification, different amounts have been mentioned for financial help to the victims of crime or their dependents, directed State to pay compensation of rupees two Lacs will be just and reasonable amount for providing financial assistance to the family of victim which shall be paid within one month by the State Government. According to the police case one Israr lodged a written complaint to the Police Station, Bhaderwah on 09/10/2006 at 4:00pm accused hit his father Abdul Majid (deceased) with a stone at some distance from their house due to which deceased died on spot. |
