Headless SAC decides 28 cases in 8 years? | | | Early Times Report
Srinagar, Aug 2: The State Accountability Commission (SAC) which is headless since August 2014 has decided only 28 cases during eight years from 2005 to 2013, reveals the official website of the said commission. The term of Chairman SAC Justice (Retired) Y P Nargotra and its member Justice (Retired) Hakeem Imtiyaz ended last year in August and till date the Government has failed to appoint the new chairman and members to this commission. Ironically the official website of SAC (www.jksac.nic.in) still carries photos and details of Justice Nargotra and Justice Imtiyaz Hussain being the Chairman and Member of SAC respectively. The J&K State Accountability Commission (SAC) was constituted under provisions of Jammu and Kashmir Accountability Commission Act, 2002. SAC has powers to inquire into the grievances and allegations against public functionaries including Chief Minister / Cabinet Ministers and for matters connected therewith. Section 3 of the J&K SAC Act 2002 , provides that the State Accountability Commission (SAC) shall consist of a Chairperson who has been a Judge of the Supreme Court or a Judge of any High Court and two other members. The SAC was constituted in the year 2003 and during its initial years it gave some good judgments which lead to suspension and even dismissal of some bureaucrats but after some years the said commission could not deliver justice and that was mainly due to official apathy. The SAC was headless for as many as four years until the appointment of Justice (Retired) Nargotra and after his term was completed it again became headless. As per the official details available on the website of SAC the commission has given judgments in only 28 cases in between 14.10.2005 to 26.2.2013. The said orders are available on SAC website " The problem with our transparency institutions / commissions is that the laws which govern these commissions have some lacunas . The J&K State Accountability Commission Act , State Human Rights Commission Act , Vigilance Commission Act and even State RTI Act 2009 don't have a provision of replacing the members / heads within a given time frame. If a Chairman of SAC retires the law does not says that the said Chairperson or the member has to be appointed within one or two months . The Government takes advantage of this lacuna and these commissions remain headless or without any members for months and years together. It is more than one year since the member of J&K SHRC retired and till date neither the member nor its chairman has been appointed, and same is the case with SAC " said RTI Activist Dr Raja Muzaffar Bhat. "Government has spent crores of tax payers' money on the salary and other allowances for SAC members , chairman and its staff , but in return the ordinary people (taxpayers) have got no relief .
