2010 killings: HC directs SIT to complete investigation in two months

SRINAGAR, Aug 4: In response to the petition in regard to the death of two youths during 2010 turmoil in valley, J&K High Court Kashmir wing today directed Special Investigation Team (SIT) of police to complete its investigation into the killing of two youths during 2010 unrest in south Kashmir's Anantnag district within two months fairing investigating officer were asked to appear in person to explain their positions.
When the hearing on petition filed by the families of the two victims viz. Bilal Ahmad Najar and Noor-ul-Amin Dugga, the a single bench of the court comprising Justice Muzaffar Hussain Attar directed SIT to file weekly status report of the investigation before its registry.
Court showing its dissatisfaction said, "Almost five years have elapsed and investigation is yet to be completed."
"The Investigating Agency is not only under statutory obligation to conclude the investigation at the earliest, but is under constitutional obligation in terms of Article 21 of the Constitution to conclude the investigation at the earliest," the bench observed, adding, the criminal justice system forms the edifice for having an orderly society."
The court directed the Investigating agency to take all steps to conclude the investigation within two months from today and report compliance to the Court.
"In case investigation is not completed by the next date then the investigating officers shall present in person before the court to explain their position," the court added.
As per petition Najar and Dugga were killed on September 19, 2010 after police allegedly opened fire on the funeral procession of another youth Maroof Ahmad Nath found klilled under mysterious conditions. Earlier as the proceedings of the case started before the court, Abdul Jabar, SSP Anantnag and Mohd Yousuf (SI) were present in person. The SSP submitted that statement of six witnesses was yet to be recorded while there are some formalities to be completed for concluding the investigation. Subsequent to his statements, the court directed him to record statements within week's time.
"The statement shall be recorded within week's time from today as all these persons would be available investigation agency being residents of the area adjacent to the alleged place of occurrence," the court added.
