HC directs Chief Eng PHE, XEn to appear in person | | | Early Times Report Srinagar, Sept 22: The J&K High Court Srinagar wing today directed Chief Engineer Public Health Engineering (PHE) Kashmir and Executive Engineer Bandipora Division to appear before it for non-compliance of its directions regarding release of pension of a retired employee. A bench of Justice Ali Muhammad Magrey directed the officers to appear personally and explain their conduct on September 28 while hearing petition in regard to censoring defiance of its order to release pensionaray benefits in favour of Head Assistant (Retd), Bashir Ahmad Sheikh. The bench said that "callousness" shown by the concerned authorities in implementing its directions is highly contemptuous. "Nobody irrespective of his stature can be allowed to make fun of its orders and play with its dignity", the court observed and said, "the pensionary benefit is a deemed right of an employee and is aimed to ensure that a retired employee lives a peaceful and dignified life." Earlier on June 12, the court had directed the Chief Engineer to settle and release pensionary benefits of the petitioner within two months when petitioner Sheikh approached the court with a plea that it is a settled law that government employee can be subjected to disciplinary action or inquiry when he is on rolls of the employer. The respondents had resisted the petition on the ground that an inquiry was initiated against the petitioner. |
