Jammu, Oct 30: Special Judge Anticorruption Jammu Sanjay Dhar today acquitted Sher Mohd Khan the then Executive Engineer PWD (R&B) Jammu, Mohammad Shafi and Kala who were booked by the Vigilance Organization Jammu (VOJ) in Disproportionate Assets (DA) Case, as VOJ failed to prove its case.
Special Judge Anticorruption Jammu Sanjay Dhar after hearing Adv KS Charak for the accused persons, observed that the prosecution has not been able to substantiate that accused have committed the offences the commission of which have been Sher Mohd Khan is in possession of assets disproportionate to his known sources of income nor has the prosecution been able to prove the charges of forgery, impersonation and cheating against any of the accused. Henceforth Court acquitted accused from the charges leveled against them.
According to the VOJ Case Sher Mohammed Khan, then Executive Engineer raised assets disproportionate to his known source of income which included commercial building at 65-Channi Himmat Jammu, two storeyed building at Bhatindi on a piece of land measuring I Kanal l0 Marlas, land measuring one Kanal falling under situated at Kursoo, Padshahi Bagh, Srinagar and had deposited lakhs of rupees in various banks. The Vigilance investigation also revealed that the accused Sher Mohammed Khan, in order to facilitate encashment of cheques, fraudulently and dishonestly opened Joint Account No. 30390 in the name of his two brothers-in-law (so called share holders) in State Bank of India, Branch Gandhi Nagar Jammu by utilizing the services of Mohammad Shafi and Kala @Riaz (impersonators).
Accordingly a case u/s 5 (l) (e) r/w section 5 (2) J&K PC Actand section 419,420,467,468 and 471 is established against the accused Sher Mohammad Khan s/o Late Misri Khan of Gujjar Colony, Channi Himmat, Jammu, then Executive Engineer, PWD (R&B) Jammu, Mohammad Shafi s/o Mohammad Hashmat of Village Channa, Mahore District Reasi at present Gujjar Bakerwal Hostel, Residency Road, Jammu, and Kala son of Mithu resident of Village Channa Tehsil Mahore District Reasi and a challan was produced against the accused persons for their judicial determination.
