HC directs GAD to file status report within 1 week
PIL highlighting delay in completion of 147 departmental inquiries

Jammu, Nov 2: A high court division bench of Justice Dhiraj Singh Thakur and Justice B S Walia today directed GAD to file status report within a week's time, reflecting the steps taken by various departments pursuant to the instructions and decisions taken by it with regard to the finalisation of 147 departmental inquiries.
The bench directed the registry to list this matter in the week commencing November 16 next.
When the PIL came up for hearing, the counsel drew the attention of the bench towards its April, 4, 2014 order wherein directions were issued to GAD to make complete disclosure with regard to the stage of inquiries, nature of charges, status of officers and their present postings so that appropriate orders were passed and directions were issued.
He also said that the status report filed by GAD on July 1, 2015 wherein it was submitted that to review the status of 147 departmental inquiries, a meeting was held on June 22, 2015 under the Chairmanship of GAD commissioner and concern was expressed for inaction by the concerned administrative departments in concluding the pending departmental inquiries and it was directed that these be concluded within a period of one month with the approval of competent authority.
He submitted that GAD had posted tainted officers on the prime positions and for this reason the departmental inquiries were not being finalised.
The GAD's counsel submitted that the various administrative departments are not cooperating with the department and this was the reason for delay in finalisation of the departmental inquiries. He submitted that few departments had reverted back to the GAD with the current status of the departmental enquiries and he requested the bench that he has received the status report from GAD and he may be granted some time to place it on record.
After considering the submissions of both the sides, the bench directed GAD to file status report within a week's time reflecting the steps taken by the various departments pursuant to the instructions and decisions taken by it with regard to the finalisation of 147 departmental inquiries.
