DB grant two week’s time to Govt to reply over ‘PIL on cement factories’

srinagar, Mar 17: A Division Bench of J&K High Court comprising Justice M H Attar and Justice B S Walia has granted state government two more weeks to file objections to a Public Interest Litigation (PIL) seeking direction to control pollution by cement factories in Pampore area in south Kashmir’s Pulwama district.
When the PIL filed by seven by residents of Khrew and Wuyan through advocate Mohammad Ashraf Wani was taken up, the Division Bench of J&K High Court comprising Justice M H Attar and Justice B S Walia granted two weeks’ time to respondents to file objections in this regard.
The petitioners have also sought directions to government to stop commissioning of new cement plant (Mehboob Cement project) with carrying capacity of 600 metric tones at Wuyun Khrew. Besides this they have sought directions to prevent, control and abate the environmental pollution caused by existing cement plants.
 ”The respondents, petitioners stated, be directed to conduct detailed survey or EIA of the area and the representations filed by the residents he considered and accordingly the commissioning of the new cement plants be disallowed in the area.
They also demanded that government to be asked to pay compensation to the people for causing pollution and such compensation be utilized for repairing the loss caused to the environment under the principles of Polluters Pay Principle (PPP) and Corporate Social Responsibility (CSR).
They also have sought directions from court to the State Pollution Control Board (SPCB) to visit on spot and conduct extensive study of the pollution caused by the cements plants and to stop the functioning of such cement plants which do not adhere to the pollution control devices and other measures as provided under rules.
The petitioners have also submitted the petition a site plan showing location of cement plants including the proposed site for Mehboob cements viz-a-viz the residential area, hospital, school and the irrigation canal. Besides an ancient temple is also located in the same vicinity to which hundreds of regular tourists are approaching from all over the India.
 ”The Wuyan and Khrew area are famous for saffron cultivation. The government of India and the State government has started project of namely Saffron Mission thereby huge money is invested to encourage Saffron cultivation and to increase the production of Saffron. And it is paradoxical in the same area the cement plants are being commissioned without any check which is illogical and self destruction of economy,” petitioners have submitted.
