SAC dismisses application of MLA Langate | Reports of alleged disproportionate assets | | Early Times Report Jammu, Feb 16: The State Accountability Commission has rejected the request of Independent MLA Engineer Abdul Rasheed to investigate into his assets in the wake of allegations against him of having amassed disproportionate assets at various places. The MLA had filed an application before the Commission seeking investigation into his assets in rebuttal to the allegations made against him. The full Commission which met a few days ago at Jammu considered the Case of MLA Engineer Abdul Rasheed and turned down his request for want of jurisdiction and dismissed the application on the ground that it had no jurisdiction to investigate or enquire into the assess of any "Public Functionary" unless a complaint was made in that regard Under Section 11 of the Jammu and Kashmir Accountability Commi-ssion Act. Application had been filed by Engineer Abdul Rasheed, sitting Member of Legislative Assembly requesting the Commission to investigate some news report regarding allegations of his having acquired huge properties at London, Shimla, Akhnoor and Kashmir besides amassing disproportionate assets against him. SAC after going through the complaint observed that the application exfacie is not maintainable for the reason of not being covered under Jammu and Kashmir Accountability Commi-ssion Act, Under Section 11 whereof complaints against 'Public Functionaries' as defined in Section 2(16) can be made by 'any person' or the 'person aggrieved' which obviously would not include the Public Functionary himself. |
