DB directives in PIL regarding play grounds | | | Early Times Report JAMMU, Mar 14: In a PIL wherein it was held as play ground should not be used for any other purpose except sport activities. If the play ground is to be used for any purpose other than the one pertaining to sports, prior permission from this Court shall be obtained. If there is a violation of the directions issued in aforesaid PIL No. 807/1998, decided on 08.05.2002, the same shall be considered as Contempt of Court and appropriate proceedings shall be initiated." A Division Bench of High Court Comprising Chief Justice Badar Durrez Ahmed and Justice Sanjeev Kumar after hearing both the sides observed that all playgrounds in question and they shall be used only for the purpose they have been earmarked, namely, for sporting activities. In so far as the order dated 11.11.2014 in WPPIL No. 20/2014 is concerned, it is clarified that the permission that is to be accorded by the Court for using any of the playgrounds for any purpose other than one pertaining to sports would only relate to Independence Day celebrations or Republic Day celebrations. Of course, the play grounds can be requisitioned for any emergency services in the event of floods, earth quakes and other natural calamities. This order shall apply to all designated playgrounds. |
