MLA Banihal accused of land grabbing

Jammu, Mar 18: District and session court Banihal has restrained MLA Banihal and his brother from carrying out any construction in a piece of land claimed to be owned by the complainant after the MLA failed to produce revenue record of the said land.
The family of a deceased Ghulam Rasool Shaheen resident of Devgole Banihal in Ramban District of Jammu and Kashmir accused Congress MLA from Banihal Vikar Rasool Wani and his brothers of grabbing their land.
The victims approached the court of Principal District and Session Court Ramban that came to the rescue of the family of the deceased by restraining the MLA and his brothers from any construction on the land in question and directed the lower court--- Court of Munsif Banihal to decide the matter within two months after Congress MLA and his brothers failed to produce the revenue documents.
The complainants pledged that they were the real owner of the land bearing Khasra No. 568/547/408 measuring 4 kanals situated at Devegol Banihal after the death of their father while the respondents claims that they are in possession of the suit land but the revenue extract does not support their claims.
The judge in his order stated that "to my mind the plaintiff/appellant has a prima facie case at this stage of the case.
The facts and circumstances of the case also reveal that if the defendants/Respondents are allowed to cause interference with the suit property the plaintiff/appellant would suffer irreparable loss. Further the balance of convenience also lies in favor of the plaintiff/appellant".
The court in its judgment set aside the impugned order and directed the court below to decide the matter afresh within two months after effecting the service upon the rest of the defendants and after hearing both the sides.
Speaking to ET, Shahdab Shaheen said that MLA was harassing them trying to grab the piece of land which was inherited to him after the death of his father. He said that the Congress MLA was using all his efforts to pressurize them to surrender the said piece of land to them. He said that the MLA was also misusing his official position to influence the revenue officials for their help in grabbing the said piece of the land. He urged upon the Chief Minister Mehbooba Mufti and the Revenue Minister Abdul Rehman Veeri to look into the matter and restrain the revenue officials from committing any fraud in favor of the influential Congress MLA. However despite repeated attempts Congress MLA Banihal could not be reach out for the comment.
