Bail denied to Judicial Officer (suspended) in alleged rape case

Jammu, May 11: Justice Janak Raj Kotwal today rejected the bail application Rajesh Kumar Abrol Sub-Judge (now suspended) who was allegedly booked by the police in rape case.
Justice Janak Raj Kotwal also dismissed the petition seeking quashment of FIR and observed that at this stage, matter need not be considered by this Court in exercise of inherent jurisdiction and the task should be left to the trial court.
According to the police case that the prosecutrix in the report lodged by her has stated the petitioner promised to extend legal help to get divorce and in echange asked her to work at his place as domestic help. He dissolved her marriage with her husband by getting a divorce deed attested by Notary Public Jammu on 07.08.2015 and told one of his PSOs to be witnessed to the said deed.
The petitioner befooled her by enacting a drama of marrying her and established physical relations with her.
Prosecutrix solemnized marriage with her in his house at Roop Nagar in presence of his PSO, Ashok Jamwal, his friend, Darshan Gupta and a pandit. The petitioner concealed his marital status from her and made her believe that she is his legally wedded wife. Thereafter, they lived like a husband and wife for one and a half years. Prosecutrix alleged further that after one year of their marriage she came to know that petitioner has betrayed her by marrying her during the lifetime of his wife, Neetu Bala. Neetu Bala thrashed her saying that she should leave the petitioner immediately as they are going to patch up soon.
Justice Janak Raj Kotwal while dismissing both the petitions, directed Trial Court to hear the parties on the question of charge, preferably on the next date fixed before the trial court and pass order on merits of the case. Needless to say, it shall be open for the petitioner to apply for bail afresh after question relating to framing of charge is decided, if he is so advised.
