Court denies pre-arrest bail to ex-Minister's brother

Jammu, June 1: Principal Sessions Judge Kathua Sanjeev Gupta today rejected the pre-arrest bail of Rajinder Singh S/O Late Ch. Saran Singh R/O Ward No.1, Kathua brother of Ex-Minister present BJP MLA Ch Lal Singh, for using derogatory remarks against Jammu & Kashmir Chief Minister.
On 21.05.2018, petitioner, while participating in a rally organized by Ch. Lal Singh, MLA Basohli, in connection with CBI enquiry in Rassana murder and rape case, addressed a group of people in the rally at Mela Morh, Hiranagar, by boarding a vehicle fitted with sound system and used objectionable language on loud speaker against the Chief Minister Mehbooba Mufti. The highly derogatory words were recorded by the associates of petitioner on mobile phone and made the video viral on social media like Whatsapp, Facebook, so that the obscene words could be listened and seen by Chief Minister and general public. On the aforesaid allegations, FIR No. 87/2018 for offence U/Ss 501/509 RPC and 66/67 of I.T. Act was registered by Police Station, Hiranagar, against the petitioner and one unknown person, who prepared the video and investigation is under progress, which is at the initial stage.
Principal Sessions Judge Kathua Sanjeev Gupta after hearing Adv KB Mahajan for the applicant whereas Public Prosecutor BB Sharma for the state observed that the words, as per police report allegedly used by the petitioner while addressing a rally, were, ex facie, abusive in nature, which insults the gender identity of the Chief Minister of the State of Jammu and Kashmir. Further, the consequences of lewd remarks in the video, which went viral on the social media, must have a painful effect on the person to whom it was addressed, after watching the video.
With these observations, Court rejected pre-arrest bail of the Rajinder Singh.
