Don't demolish structures, pay four times compensation: HC to Govt | Land Acquisition in Marh, Bhalwal | | Early Times Report
SRINAGAR, June 8: Another group of farmers affected by Ring Road project in Marh and Bhalwal tehsils of Jammu district have got a great relief from High Court as Government has been directed not to demolish any structures of the petitioners unless payment is made as per October 4th 2017 communication of National Highway Authority of India (NHAI) ie 4 times more than the market value of land. Details available with Early Times reveal that after issuing an interim order in favour of farmers affected by Semi Ring Road in Srinagar , the High Court has issued another order in favour of farmers affected by Ring Road in Marh and Bhalwal tehsils od district Jammu. High Court Justice S K Gupta in his interim order in the writ petition Amri Singh V/S State of J&K has directed the respondents Commissioner Secretary to Govt Revenue Department , Chairman National Highway Authority of India (NHAI) and Deputy Commissioner Jammu not to demolish any structures without payment of compensation as per the NHAI's communication of Oct 4th 2017. Pertinent to mention that in its October 4th 2017 communication NHAI had shown its willingness to pay 4 times more compensation to affected farmers of the Ring Road in Budgam district provided state adopted Central Land Acquisition Act of 2013. The counsel for the petitioners Advocate Anil Sethi raised same point before the High Court as the same was raised by M Y Bhat advocate in Srinagar as well in April this year when affected farmers of Budgam , Srinagar and Pulwama had got a relief from the court. Justice M K Hanjura had quoted the same communication in his interim order and directed the Govt to pay compensation to farmers as per Oct 4th 2017 letter of NHAI addressed to DC Budgam. High Court in its interim order filed by another group of affected farmers from Jammu region through their counsel Advocate Abhinav Sharma had directed J&K Government to file their objections. High Court Justice M K Hanjura had directed the respondents to consider the payment of compensation as per the previous communication of NHAI dated Oct 4th 2017. Only few weeks back High Court acting Chief Justice Alok Aradhe in his direction had directed that all the record of land acquisition in Chadoora sub division in Budgam be immediately transferred to Sub Divisional Magistrate (SDM) Chadoora so that he can take up the process of land acquisition in his sub division which until now had been undertaken by Assistant Commissioner (Revenue) Budgam. |
