Jammu, June 8: A KAS Officer is allegedly putting tiles on the already constructed area over encroached nallah and public lane at Sarwal area, in violation of a court order. As per documents in possession of Early Times, a complainant, Sanjay Gupta, had filed a PIL in the High Court against Anil Kumar Gupta (KAS officer) for encroaching a nallah and raising construction on it. Another complaint was filed against Jammu Municipal Corporation, following which the court passed directions to the concerned agencies to maintain a status quo. Despite clear directions passed by the court, the KAS officer, being an influential person, without bothering for the interim direction passed by the court started putting tiles on the already constructed area over the encroached nallah and public lane. The work is going on a great pace. "If the order passed by the court is not implemented in letter and spirit through the agency of police, then the KAS officer would succeed in his nefarious designs and there is every apprehension of breach of peace being broken on the spot," said the complainant. The complainant said that he had approached the concerned police post and apprised the in-charge there about the situation. "But instead of taking any action against the KAS officer, the Chowki Officer told me that he got the court order implemented and compliance report has also been filed," said the complainant. Quoting J&K Water Resources Act, he said all water bodies including nallah (big drain) are the property of the state and if anyone encroaches upon the water resources, legal action would be taken against him/her under the law. But despite the encroachment of the nallah in Sarwal, no action has taken against the violator. Incharge police post Sarwal, Jitender Singh Rakwal, said that the court order was implemented and compliance report was also filed in the court. When asked how the KAS officer was putting tiles, he said he cannot take action. JMC's Chief Enforcement Officer, Kamini Kesar said that the KAS officer "can put tiles on the already constructed work as court has passed direction on construction on the spot. It is no violation of the court order." |
