Court awards 25 years RI to narco smuggler | | | Early Times Report JAMMU, Nov 22: Principal Sessions Judge Jammu Vinod Chatterji Koul today awarded 25 years RI and fine of Rs 2 lakhs to Paramjeet Singh S/o Lachman Dass @ Lachman Singh R/O Village Alampur Baka, Tehsil and P.S Kartarpur, District Jallandhar from whose possession 100 bags of poppy straw was recovered. While awarding sentence, Principal Sessions Judge Jammu Vinod Chatterji Koul after hearing Public Prosecutor Rakesh Badyal for the state observed that while awarding sentence certain important facts are to be taken into consideration i.e the previous conduct of the accused, nature of the offence and effect of the commission of such offence on the society as well as the health of the young generation and as to how the menace of drug has spoiled the youth. The menace of drug is the major threat to the society at large and economy of the country. The menace of drug has taken away lives of large number of children and has destroyed many families and has increased the crime rate and is also used to destruct the youth. As is established from the evidence, the accused had been previously involved in the contravention of the provisions of the NDPS Act and had been found in possession of the narcotic substances. The way the poppy straw was being smuggled underneath specially designed flooring of the Truck shows that the Truck had been specially prepared and designed only for the smuggling and transportation of the narcotic substances. Further the evidence reveals that on previous five occasions the instant truck had entered and left the state empty, thereby interference is drawn that the accused had been using the truck for the smuggling and transportation of the contraband, rather than for the legal purposes. Thus, these facts are aggravating ones, as such, in such circumstances no lenient view can be taken in favour of the accused, who being habitual violator of the provisions of NDPS Act. With these observations, Principal Sessions Judge Jammu Vinod Chatterji Koul ordered that the adequate sentence must commensurate with the level of his guilt, as such rigorous imprisonment for a period of twenty years and fine of Rs 2,00,000/ u/s 8/15 NDPS Act is awarded to the accused namely Paramjeet Singh, as the contravention involves commercial quantity and in case of default in payment of fine, he shall undergo a further rigorous imprisonment for a period of one year. He shall also undergo rigorous imprisonment for a period of two years u/s 465 RPC and fine of Rs 1000 and in case of default in payment of fine, he shall undergo a further rigorous imprisonment for a period of one month. He shall also undergo rigorous imprisonment for a period of three years and fine of Rs. 5000 u/s 471 RPC and in case of default in payment of fine, he shall undergo a further rigorous imprisonment for two months. However, all sentences shall run concurrently. |
