Jammu, Mar 7: In a petition filed by Ghulam Mehdi and another aggrieved of order dated 18.02.2019 bearing No. Estt-i/Edu/Transfer-teacher/2017 issued by the Respondent No. 3, in terms whereof, the Petitioner No. 1 has been transferred from High School, Kargee to High School Parkachik and the Petitioner No. 2 has been transferred from ZEO Office, Tai Suru to ZEO Office, Drass, on the grounds detailed in the petition with particular reference that the order has been issued by the Additional Deputy Commissioner, Kargil, who has no authority to issue any order on behalf of LHDC, Kargil.
Justice Ali Mohammad Magrey while dismissing the petition observed that every employee working in the Government establishment has to render services as per the requirement of the employer. Justice Magrey further observed that the ground taken in the writ petition that the order has not been issued by the competent authority has no substance. From the perusal of the order, it comes for fore that same is issued from the office of Chief Executive Councilor, LAHDC, Kargil and with the approval of Chief Execution Officer, Kargil, therefore, meets the requirement of law. |
