After sticking to previous position illegally, Law officer relieved after 5 months

JAMMU, Mar 7: Taking cognizance of news item published in Early Times newspaper, authorities of Jammu and Kashmir State Power Development Corporation (JKSPDC) have finally relived Showkat Ahmad Mir-Additional Secretary/ Senior General Manager (Law).
As per order no 4637-LD (ESTT) of 2018 dated 21-08-2018 issued by the Department of Law, Justice and Parliamentary Affairs which is also in possession of Early Times, 25 law officers including Showkat Ahmad Mir-Additional Secretary/ Senior General Manager (Law)were transferred.
"The transferred officers/officials shall be deemed to have been relieved from the date of issuance of this order" further reads the order.
The transfer order issued by the Department of Law, Justice and Parliamentary Affairs in favour of a Law officer and subsequently further directions for his immediate relieving was not sufficient for Showkat Ahmad Mir who illegally sat on the said chair for couple of months after being transfer and relieved which was mentioned in the order.
The Law officer Showkat Ahmad Mir who was posted in Jammu and Kashmir State Power Development Corporation and transferred to department the Department of Law, Justice and Parliamentary Affairs did not comply with the order issued by the Department.
Meanwhile, owing to the non compliance of the transfer order issued by the Department of Law, Justice and Parliamentary Affairs, the Department issued another circular for the officers to comply with the directions without any further delay by 13th of September of 2018 but is could not be materialized.
GAD issued a circular vide order no LD (ESTT) 2018/P-BN General Administration Department (GAD) vide Circular No. 38 GAD of 2018 dated 7-09-2018 has directed officers concerned who have been transferred under different Government Orders in the recent past but have not joined their new places of postings to do so without any further delay by 13th of September of 2018 falling which action as warranted under rules will follow.
"All Additional Secretaries/Senior Law Officers/Deputy Legal Remembrancers/Public Law Officers /Assistant Legal Remembrance are directed to comply with the Government Order No. 4637 -LD (EsTT) of 2018 dated 21-08-2018 and Government Order No. 4714-LD (EsTT) of 31-08-2018 read with circular instructions issued by the General Administration Department letter and spirit", further reads the circular.
It was clearly mentioned in the circular that the transferred officers are deemed to be relieved and when the order was not complied upon by some officers including Showkat Ahmad Mir, a circular was issued by the GAD for relieving of the such officers by 13th of September of 2018 which was also not complied upon by the Mir and he was relieved by the JKSPDC on March 6 which clearly shows that he occupied by the said chair illegally and too in violation of circular of GAD.
