Govt servant has no right to remain posted at one place: HC | | | Early Times Report Jammu, Apr 10: In a petition filed by Neelam Devi & ors who were working as Female Multipurpose Health Workers challenging their transfer orders, Justice Sindhu Sharma after hearing Adv IH Bhat for petitioners, held that a transfer is an incidence of service and a Government servant holding a transferable post has not vested right to remain posted at one place or other. The transfer orders issued by the competent authority did not violate any of his legal rights. The transfer can only be challenged on three grounds i.e. transfer can be interfered, namely, if the order of transfer is passed in violation of any statutory Rule, or on mala fide reasons or by an incompetent authority. With these observations high Court dismissed the appeal. |
