Court rejects bail of BSF jawan in attempt to murder case

JAMMU, Mar 3: CJM Ajay Gupta rejected the bail application of Samar Pal, son of Nayan Ranjan of Pairagacha Janai District Hoogli West Bengal, who was posted in BSF and tried to murder senior BSF officer.
During the course of hearing Anil Saini submitted that the accused is an expert of explosive substance and has made an unsuccessful attempt to murder a senior officer of the BSF and to create panic in the Country. It is also stated that if the bail application of the accused is consider , he may came in contacts with the anti national elements and may harm the society at large.
CJM Ajay Kumar Gupta after hearing both the sides observed that the accused is involved in a serious and heinous offence and the investigation are yet to be complete and prima facie involvement of the accused in the above mentioned case has been made out. Furthermore there is every apprehension that the accused will tamper the evidence and will jump over the bail and will not be arrested again as he is not a local resident and is a resident of state of West Bengal. Thus, if in such type of serious and heinous offences the accused is granted bail, it will certainly the affect the larger interest of public and the State and in particular the security of the country. The general public will lose its faith in criminal justice system. Such type of accused is not entitled to the discretionary jurisdiction of the court for granting the bail. Thus, this is fit case where the bail application of the accused needs to be rejected. With these observations Court rejected the bail application. (JNF)
