KAS seniority: High court issues contempt notice to CS, others

JAMMU, Mar 4: In a much publicised case of fixing of seniority of KAS officials, the Jammu and Kashmir High Court issued contempt notice against Chief Secretary and others for their failure to comply with the court directions.
As per the details available with Early Times, the contentious issue of seniority of KAS remains unsettled and the petitioners are approaching the court continuously. The directions was passed by the High Court in a petition filled by Mohammad Hanief Balki and others.
As per sources, the government of Jammu and Kashmir issued the seniority in year 2003, but dropped some of the officers who were already eligible and stood appointed in year 1992.
Pertinent to mention that government despite availability of slots to various services did not prefer to induct officers from 2004 onwards and picked up few blue eyed officers for induction into time scale. Some were however inducted illegally in year 2008 and the year wise tentative seniority list issued on the basis of availability of slots was reversed in year 2010 to advance favour to irregularly appointed which resulted into multilplicty of litigation.
It is further alleged by petitioners that some officers who were beneficiaries of illegality were theirself dealing with case in GAD and issued 3-4 separate seniority lists breaking the batches and interpretting things to their convenience.
This compelled petitioners to challenge the case and the High court stayed the seniority list issued in year 2014 pertaining to officers of technical quota as slots were denied to them while fixing seniority.
However despite clear cut stay on the seniority list of 2001 combined services batch, BVR Subramanium Chief Secretary disobeyed the directions and went ahead by operating the list for release of non functional grade first and then substantive promotions to junior officers. The gross violation of court order has been agitated by filing contempt petition against Chief Secretary, Secretary GAD and one charandeep singh dealing with case.
Taking cognizance of matter and upon hearing the pleadings , the High court issued contempt notice against Chief Secretary and others and listed the case for furher hearing on 15-4-2020.
