Contempt proceedings initiated against DC, ACR Doda, others | | | Early Times Report
DODA, July 24: In a petition filed before the Court of Sub Judge Doda for initiating contempt proceedings against DC Doda, ACR Doda, DFO Doda and others for willful disobedience towards the order of the Court, interfering in the judicial proceedings and administration of justice undermining the authority of the court in public display, the court of the Civil Judge Senior Division Doda ordered for initiating the contempt proceedings against the Deputy Commissioner Doda, Assistant Commissioner Revenue Doda and others and fix the next date of hearing for 25-7-2020 as to why the contempt proceedings should not be framed against them. As per the details available with “Early Times, the petitioners Hasim Din and others had filed a contempt petition after their house was publically damaged by using excavation machines destroying all the household belongings and daily use necessities of even women and children causing loss of at least Rs 20 lakh to the petitioners without prejudice to the petition who reserve the right to file suit for damages against the contemnors. The Counsel of the petitioner also leveled serious allegations against the senior officials of the District Administration wherein they also allegedly abuse the counsel of the petitioner while he tried to explain them about the court orders. As per the order passed by the court stated that the counsel of the petitioners Hakam Din, Ghulam Mohammad and Mir Hussain all sons of Noor Din of Shamdhak, Malwas Doda filed a contempt petition against the senior officials of the District Administration Doda wherein it has been reported that on 12-03-2020 direction was passed to the SHO concerned for implementation of the order in its letter and spirit. After perusing the contents of the petition in which serious allegations have been leveled against the alleged contemnors and the alleged allegation are also serious in nature, if true, undermines the sanctity of the judicial system and amounts to interference in the function of justice delivery system. “It is the rule of natural justice and fair play that nobody should be condemned unheard and it is the duty of the court to give opportunity of being heard to both sides. Therefore in view of the aforesaid rule- office is directed to issue notice to allege contemnors, so that all the contemnors shall appear before the court to explain as to why “Contempt should not be framed” against them” read the order. |
