HC restrains from declaring result of election of Panch in Targwal | | | Early Times Report JAMMU, Nov 27: Justice Tashi Rabstan restrain from declaring the result of election of Ward No 6 in Panchayat Halqa Targwal, reserved for Scheduled Caste category. Adv Ajay Bakshi appearing for the petitioners submitted that petitioners challenge the notifications dated 05.11.2020 and 03.11.2018 whereby the Ward No 6 in Panchayat Halqa Targwal was declared as reserved for Scheduled Caste Category on the ground that there is no population of Scheduled Caste category in the Ward. Adv Ajay Bakshi appearing for the petitioner argued that the reserving of seat for Scheduled Caste Category in Ward No. 6 in Panchayat Halqa Targwal is against the mandate of Article 243-D of the Constitution of India as well the Rule 4(c) of the Jammu and Kashmir Panchayat Raj Rules, 1996. Justice Rabstan observed that as the petitioners are seeking rejection of nomination papers of respondents No 5 and 6, therefore it is not appropriate for this Court to finally consider the petition in their absence, whereas, learned counsel for the petitioners is pressing hard for final consideration because the election is scheduled to be held tomorrow i.e., on 28.11.2020. In these circumstances, counsel for the petitioners is directed to serve the respondent Nos. 5 and 6 personally and shall file the service affidavit by or before the next date of hearing. Meanwhile, respondents are directed to conduct the elections, however until further orders from this Court they shall not declare the result of Ward No. 6 in Panchayat Halqa Targwal, reserved for Scheduled Caste category. —JNF |
