Jammu, Feb 9: Block Development Council, Chairperson R S Pura likely to face tough time ahead, as the Court of Chief Judicial Magistrate (CJM) Jammu has denied to stay no confidence motion against him moved by 13 Sarpanches of block R S Pura, over his alleged misconduct. The CJM Jammu Ajay Kumar Gupta after hearing arguments by Counsels of both parties found no merit in the appeal made by the applicant Tarsame Kumar, BDC Chairperson R. S. Pura through his counsel Ankur Sharma and Pankaj Sharma. The applicant has sought relief of permanent injunction to defendants including 13 Sarpanches, the Secretary BDC (BDO R S Pura) and the District Panchayat Officer (DPO) Jammu. But listening the Counsel of the defendants 13 Sarpanches, Anil Bargotra and Satinder Gupta, CJM Jammu in his order said that keeping in view the detailed facts mentioned hereinabove and the judgement passed by J&K High Court, the applicant has failed to make out a prima facie case in his favour. “The other two requirements to obtain an interim injunction i.e. balance of convenience and irreparable loss also do not exist in favour of the applicant. Moreover, he is unable to make out any case at this stage whereby, it can be stated that impugned notice is illegal and has been issued without following the mandate of law”, the court mentioned in order. “As the applicant has failed to make out any case at this stage to get the interim relief. Thus, the application is without merit and is accordingly dismissed. However, this order will not have any impact upon the merits of the main suit”, the court said the court, while disposing off the appeal. The CJM further said that the application was disposed of accordingly and the same should become part of the main file after its due compilation. |
