CJM rejects bail of notorious thief | | | EARLY TIMES REPORT
JAMMU, Apr 30: CJM Jammu Amarjeet Singh Langeh rejected the bail application of a notorious thief who was arrested by the Janipur Police station. While rejecting bail of Ajaz Ahmad, CJM Amarjeet Singh Langeh observed that after examination of police report would explicitly reveal that a complaint with regard to theft of Car bearing registration no. JK14E-7669 was lodged with non-applicant police station by the complainant alleging that while said car was parked outside the house of complainant at Paloura, someone committed its theft. Based on this complaint FIR no. 39/2021 for offence under section 379 of IPC was registered and investigation started. Evidence gathered during investigation demonstrates an astonishing extent of fearlessness that applicant has shown while stealing vehicles and then smuggling them out of UT of J&K via Punjab upto Delhi. Without a doubt, evidence gathered against the applicant during investigation would clearly albeit prima facie show that he is not only a serial offender but a perennially lurking threat to life and property of public at large. In these circumstances grant of bail to applicant would amount to playing to his strength much to the chagrin of innocent public more particularly when incidents of theft of vehicles have shown an alarming rise in recent times. It needs no re-iteration that the character of evidence gathered during investigation, gravity of the offences involved, the character and antecedents of accused and larger interest of public in the event of grant of bail are the fewest of the circumstances that need to be considered. In the instant case all these circumstances are poignantly poised against the applicant, more particularly when some vital aspects of the matter are still under investigation. CJM observed that exploring options under other existing statute after preparing dossier of serial offenders would be a response from State that will not only instill but reinforce faith of prevalence of law in public reeling under constant state of fear of being targeted by gang of thieves and sense of fear and deterrence of law in serial offenders.
