Court acquits accused in rape case | | | Early Times Report JAMMU, Apr 25: Presiding Officer Fast Track Court Khalil Ahmed Chowdhary has acquited Ravi Rakwal from the rape charges as prosecution case fails. On 13-3-2018, complainant Pyare Lal along with his daughter (name withheld) came to Police Station Janipur and lodged a written report stating therein that he along with his wife is residing in Gujjar Mohalla Janipur. On 9-3-2018, when he and his wife were away from their residential room, accused made an entry and torn clothes of his daughter and after closing her mouth, the accused outraged her modesty and told her not to disclose the incident to any person failing which she will be eliminated. The victim reported the matter to Police Station on 9-3-2018 and again came to the police station on 13-3-2018 with her father and filed a written report, upon which said FIR was registered. Her age particulars were ascertained and as per radiologist age of the victim was between 12-15 years, whereas, as per school record her date of birth was 12-11-2006. After completion of the investigation Challan was produced against the accused in the court of Judicial Magistrate 1st Class City Judge Jammu where from same was committed to the Court of Principal District Judge Jammu on 9-6-2018 and the court of Principal District Judge Jammu transferred the same to the court of 3rd Additional Sessions Judge Jammu on 11-7-2018 and in the meanwhile on the creation of this Court as Fast Track Court case came to be transferred to this court on 30-4-2021. Presiding Officer Fast Track Court Khalil Ahmed Chowdhary observed that over all analysis of the evidence of prosecutrix as well as the doctor witness, with regard to committing of sexual intercourse by the accused there are major contradictions in their statements which creates doubt with regard to committing of rape by the accused. Therefore, on cumulative consideration of the matter in its totality having regard to the statements of witnesses would suggest that there is no concrete evidence on record connecting the accused with the commission of offence. The evidence of witnesses is not corroborative leaving doubt in the prosecution case. The judge observed that the prosecution case fails and accused is accordingly acquitted of the charges levelled against him. Accused Ravi Rakwal S/o Din Dayal Rakwal R/o Khajwa District Chattarpur M.P at present Janipur Colony Extension Jammu who is in custody is ordered to be released forthwith. |
