Jammu, Aug 13: First Additional Sessions Judge, Jammu, M A Chowdhary today rejected the bail application of Aap Shambu temple desecration case accused. With criminal intention, accused Yasir Alfaz had entered the Aap Shambu temple at Roop Nagar here on June 14, 2016 at about 4.10 pmand broke the sacred idols and their ornaments and scattered them here and there inside the premises. He had also issued life threats to public servants and civilians, according to police case. During investigation, it was established that he had insulted the religious sentiments of a particular religion. He was arrested and booked by Janipura police under sections 295, 295-A, 353 and 506 of RPC. The judge, after hearing the two sides, observed that the mode and manner in which the offence had been committed, the sentiments and emotions of a religious community having faith in Lord Shiva were attempted to be challenged. This act had created law and order problem and in view of the attending circumstances, the accused, in 'my considered opinion, is not entitled to bail at this stage, particularly when status of his mental health is being examined by a Board of Doctors, whose report is expected shortly and moreover the charge is yet to be framed'. With these observations, the court rejected his bail application (JNF). |
