JAKFED MD, GM in dock for observing court orders in breach

Srinagar, Nov 21: For observing its directions in breach in a case involving promotion of an employee of the cooperative society, J&K High Court has issued bailable warrants against Managing Director (MD) as well as General Manager (GM) of J&K Cooperative Supply and Marketing Federation Limited (JAKFED).
A bench of Justice Ali Muhammad Magrey, directed Inspector General Police (IGP) Jammu to execute the warrants against the said authorities by November 28.
"Neither compliance of order, dated October 14, 2016, has been filed, nor are the respondents-- MD as well as and GM of JAKFED-- present in person," the court said, adding no option is left with it but to adopt the coercive methods to secure the presence of the officers.
While the court asked its Registry to issue bailable warrant in the sum of Rs 50,000 each against MD as also GM of JAKFED, it ordered IGP Jammu to execute the warrants. "Failure to execute the warrants shall entail action against the executing officer," the court said.
On September 8, 2016, the High Court had directed the respondents to consider JAKFED Manager, Muhammad Tahseen Dar for promotion against the post of Assistant General Manager and Deputy General Manager. Even as the court had directed the authorities to pass the orders of promotion in favour of the petitioner within a period of four weeks, it had asked them to appear in person if they failed to promote the petitioner. The respondents filed an appeal against the Court order of September 8, 2016, before a division bench. The bench while modifying the order, however, directed the respondents to accord consideration in accordance with order dated 27-12-2013, to the representation already filed by the petitioner within two weeks.
"The result of the consideration of the representation shall be conveyed to the petitioner, whether in affirmative or negative, and if they fail to do so, the respondents, shall remain present before the court and explain the cause of delay in implementing the court orders," the court said
