DHS, others directed to appear in court

Jammu, Nov 28: High court judge B S Walia has directed the director health services (DHS), Jammu, chief medical officer and medical superintendent of district hospital, Rajouri, to appear in person along with the record of the case of 'allotment' of a contract of sanitation services for the Rajouri hospital.
Expressing displeasure over the lack of assistance from the state government, he said that none was present on behalf of respondents despite time having been taken by the AAG to obtain instructions in the matter.
The petitioner's counsel drew the attention of the court towards a communication No 1242/CTO/RP of November 16, 2016 issued by the commercial tax officer, Rajouri-Poonch circle, whereby it was intimated that M/s Rajouri Sanitation Club was not registered with his office and as such had not obtained any tax clearance certificate from the office.
He submitted that one of the conditions of the contract for providing sanitation services in the Rajouri district hospital was that the contractor should enclose experience certificate, if any, the bank statement of last two years and an income tax clearance certificate from IT department. No such requirement was possessed by the shortlisted contractor -- M/s Rajouri Sanitation Club - but despite that the medical superintendent of the district hospital was hell bent to award it the contract, he alleged.
He also drew the court attention to the complaint lodged with DC, Rajouri, and also the detailed report summoned by additional DC (District Vigilance Officer), Rajouri, from the medical superintendent, but he had not bothered to submit the requisite report which constrained the petitioner to move the court.
After hearing him, Justice Walia took serious note of the absence of state respondents and directed the DHS, CMO and medical superintendent to remain present in court on the next date of hearing along with the record. In the meantime, the interim directions would continue, the court directed.
