Appointment of HC Judges: Issue must not be politicized, says Justice Attar

Pahalgam, Nov 28: Emphasizing the need and importance of Judiciary, Justice Muzaffer Hussain Attar on Monday said that issue of appointment of High Court Judges must not be politicized.
After inaugurated a Munsif Court in Pahalgam of South Kashmir, Justice MH Attar said that if Judges will work with honesty, dearth of Judges will not affect the judiciary work culture.
"In a democratic country like ours, everything works under the constitution. To implement, enforce and maintain the rule of law Judiciary has important role to play without judiciary. It's not possible to maintain the rule of law," Justice Attar told media on the sidelines of the function.
"Its fact that there is shortage of Judges and vacancies need to be filled but at the same time this issue must not be politicized. Such issues are being discussed in a closed door with the elected government not in a public place," he added.
Justice MH Attar said that if Judges will work with honesty and responsibility the dearth of Judges will not make any adverse affect on the work culture of judiciary.
Pertinent to mention here, a war of words between the central Government and Chief Justice of India TS Thakur broke out after later accused the Narendra Modi led government of not providing proper facilities to judiciary.
"Courtrooms are vacant but we've no judges. Around 500 vacancies in High courts today, 500 HC judges should be working today; they are not working," CJI Thakur was quoted having said in New Delhi. However, Law Minister Ravi Shankar Prasad strongly disagreed and said that the government has made 120 appointments this year which was the second highest number since 1990.
Over the issue of non-compliance of court orders by the government functionaries particularly Police, he said, "It is responsibility of every government authority to implement the court orders. As a High Court Judge I must tell about myself.
My directions are being implemented and so every Judge must take it seriously as it is his legal bounding as well as the religious duty to get his direction implemented," he said, adding any non-compliance by any government agency or official will be punished under rule of the law.
Justice MH Attar said that opening up the Munsif Court in Pahalgam will provide a relief to residents of Pahalgam and people residing in far off areas who were facing problems by travelling to Aishmuqam Munisf Court.
Deputy Commissioner Anantnag, Dr Syed Aanid Rasheed Shah, District Principal Session Judge, Munsif Judge Aishmuqam, Chief Executive Officer of Pahalgam Development Authority and other senior officials from Judiciary and district administration accompanied Justice MH Attar.
