DB directives in Suo-Moto PIL regarding shortage of LPG | | | Early Times Report
Jammu, Mar 23 (JNF): In the much publicized Court on its own motion Public Interest Litigation regarding the crises because of shortage of LPG gas due to cap announced by Central Government, a Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Bansi Lal Bhat issued various directions and disposed of the PIL. When the PIL came-up for hearing, Division Bench observed that as per the Court direction, the affidavit was filed and same was taken note of and further clarifications were sought for from Oil Companies and the Secretary to Government, Petroleum and Natural Gas, New Delhi, after they were impleaded. Further direction was issued to convene a meeting by the Divisional Commissioner, Kashmir and submit a report. Division Bench further observed that status report supported by affidavits dated 13.03.2015 is filed. It is stated therein that all the blocks in the State of J&K are being supplied with Gas through Oil Marketing Companies Distributorships and after this public interest litigation was initiated, the oil marketing companies have advertised 193 number of LPG distributorships (IOC-81, HPC-77, BPC-35). Out of these 39 LPG distributorships have been made workable/commissioned. In 71 locations the selection is under process and in selected cases the Letter of Intent will be issued within four months, 69 locations are to be re-advertised, 4 locations have been issued Letter of Intent which will be made workable by September, 2015 and insofar as 10 locations are concerned the selection process has been stalled by Court cases. When this Court put a specific question with regard to the time limit required for completing the commissioning of distributorships except where the selection process are stayed due to Court cases, R.Koul, learned counsel submitted that by the end of 2015 the Oil Companies will be in a position to commission the agencies. Sr. Advocate DC Raina submitted that if the matter is closed there may not be any further progress and the case may be adjourned to watch the further progress. In reply to the said submission Advocate R.Koul, counsel appearing for the Oil Companies submitted that the statement made by him may be recorded and the petition may be disposed of as the respondents will adhere to the assurance given before this Court. Division Bench disposed of the petition in the light of the specific statement made by Advocate R Koul appearing for the Oil Companies, stating that the LPG distributorships in all the areas will be commissioned before the end of December, 2015 except where the selection process is stalled by Court orders. |
