SIC directs JMC to give details under RTI | Info about approved site plans | | Early Times Report
Jammu, July 5: The State Information Commission (SIC) has directed the Jammu Municipal Corporation (JMC) to reveal details of approved site plans, both commercial as well as residential, in Channi Himmat area of Jammu city. The said information was denied earlier under RTI Act, which forced the RTI applicant to file an appeal before SIC. The SIC has also directed the JMC authorities not to charge any fees from the him in lieu of the information. Details available with Early Times reveal that one S Kumar had moved an application on October 14, 2014 before PIO/Secretary, JMC, Town Hall, Jammu, under the Jammu & Kashmir Right to Information Act, 2009 (JK RTI Act) wherein he sought certain information relating to approved site plans for commercial/residential buildings at Channi Himmat Housing Colony, Jammu. The PIO vide office letter No JMC/S/RTI/45-46 dated 10.04.2015 addressed to the commission submitted that the applicant is claiming voluminous information which pertains to Senior Town Planner and Chief Enforcement Officer-III and the application was forwarded to both the concerned officers under section 6 of J&K Right to Information Act, 2009 vide letter No JMC/S/RTI/4246-49 dated 18.10.2014. The PIO further submitted that the information provided by Senior Town Planner vide letter No 969-70/BS/14 dated 19.10.2014 was incomplete, whereas, Chief Enforcement Officer-III vide letter No.MJ/CEO/526/ dated 15.11.2014 replied to some of the paras, the copy of the reply submitted by Chief Enforcement Officer was also sent to Senior Town Planner for providing the revised information in consonance with reply of Chief Enforcement Officer. The record shows that the appellant also filed first appeal before the Commissioner, Municipal Corporation, Jammu/First Appellate Authority (FAA) on 18.11.2014 which was heard on 20.01.2015 and the First Appellate Authority (FAA) disposed of the appeal with the directions to the PIO to provide the information to the information seeker. The PIO has also submitted that the information from the Senior Town Planner was received on 13.02.2015 and the same was provided to the information seeker vide letter No.JMC/S/RTI/4855 dated 23.02.2015. In second appeal filed before the State Information Commission (SIC) , the information seeker has alleged that the PIO/Secretary, Municipal Corporation, Jammu has not furnished the complete information as asked vide his RTI application. During the course of proceedings on 23.6.2015, the JMC Commissioner apprised the Commission (SIC) that the PIO has been deputed on magisterial duty for conducting Amarnath Yatra by the government and as such no substitute has been designated as PIO in his place. He further submitted that though the information sought by the information seeker stands already furnished to him, however, certain queries raised by him which have allegedly not been responded, revised information relating to these queries will be furnished to the information seeker and sought ten days time to do the needful. "In view of the submissions made by JMC Commissioner, it is hereby ordered that the revised information as sought by the information seeker in his RTI application be provided to him available in office record free of cost within 10 days from the date of receipt of this order under an intimation to the Commission" reads the SIC order. |
