DB suspends life-sentence, grants bail to woman convicted of killing her husband

Jammu, July 28: A Division Bench of State High Court comprising Justice Bansi Lal Bhat and Justice Janak Raj Kotwal today suspended the life-imprisonment of Bimla Devi who was convicted and sentenced by the Additional Sessions Judge Udhampur in murder of her husband.
Division Bench after hearing Sr Adv B S Salathia with Adv Meenakshi Salathia appearing for the convict, observed that accused is a woman and it is not denied that her two minor children stand deprived of parental care. Court also observed that the co-accused Suram Chand has been acquitted and these factors, taken cumulatively, warranted admission of petitioner on bail.
Court allowed bail application and petitioner is bailed out subject to furnishing of surety bonds in an amount of Rs.1.00 lakh each (Rupees One Lakh) and personal recognizance bond of the same amount to the satisfaction of Registrar Judicial of this Court, with the conditions that the applicant/convict shall attend this Court on each and every date of hearing of her appeal against conviction and sentence.
Court also directed that applicant/convict shall keep the SHO, Police Station Ramnagar informed of her whereabouts and applicant/convict shall not leave the State without seeking prior permission from this Court. According to the police case that on September 25, 2007 at about 8.45 AM, information was received at Police Station Ramnagar that body of one Babu Ram son of Prem Nath alias Premu of Kirmoo Mora Nambla Tehsil Ramnagar has been found hanging from a tree. Initially police started inquest proceedings u/s 174 CrPC. Meanwhile report of viscera was obtained in SDH Ramnagar from FSL Jammu and it opined that the death was due to strangulation. And thus inquest proceedings culminated and case under commission of offence punishable u/s 302 RPC. Accused Bimla Devi was arrested as suspect u/s 54 CrPC who during interrogation disclosed that she along with co-accused Suram Chand with common criminal intention gagged the deceased Babu Ram strangulated with 'dupatta' and thereafter hanged the dead body with a rope on tree. The disclosure statement of the accused Bimla Devi was recorded. On completion of investigation, the police presented this charge sheet against the accused. In the year 2013, Additional Sessions Judge Uhdmapur convicted the accused and awarded life-imprisonment. Against this present appeal was filed.
