Prosecution failure leads to acquittal of man, others in dowry death case | | | Early Times Report Jammu, Aug 22: Principal Sessions Judge, Udhampur, R S Jain today acquitted Rajesh Kumar (husband), Puran Chand (father-in-law) and Kiran Bala (mother-in-law) in a dowry death case as prosecution failed to prove its case. According to the police case, PSI Shafeeq Ahmed on March 9, 2013 recorded the statement of Santosh Kumari in GMCH, Jammu, wherein she stated that she was married to Rajesh Kumar, son of Puran Chand of ward No 4, Ramnagar, about three years ago and has a nearly 1.5 year old son. Soon after the wedding, her husband, mother-in-law Kiran Bala and father-in-law Puran Chand started abusing and torturing her for bringing Rs 5 lakh from her parents otherwise they would finish her. She went to her parents and informed her mother Raj Devi and her brother Ashu Gupta about the demand and to arrange Rs 5 lakh otherwise the said persons would kill her. She always used to tell her in-laws that her parents were poor and but the accused never listened to her. On March 7, 2013, in the evening she was at home when her husband and mother-in-law raking up the demand of dowry started fighting with her and beating her. Thereafter her husband went to the market and at about 12 O'clock in the night came back home. She was sleeping but he woke her up and started beating her again. She started screaming and on hearing her screams, her mother-in-law and father-in-law came on spot and joined her husband. Getting an opportunity, she called up her brother Ashu Gupta on his cellphone and narrated him the entire episode and during this period, her husband took her outside and to kill her tied her with a rope. Her mother-in-law from the kitchen brought a bottle of kerosene oil and her mother-in-law and father-in-law having a common criminal intention sprinkled the kerosene oil on her and her husband set her on fire by lighting a match-box. She became unconscious and when she regained conscious, she found herself in the hospital. On this, police registered a case and after completion of investigation challan was presented. After hearing both the sides, the court observed that in the present case prosecution has been unable to prove the guilt of the accused beyond reasonable doubts by cogent and clear evidence and the court is of the opinion that the evidence falls short of the required standard of proof. Hence accused Rajesh Kumar, Puran Chand and Kiran Mala are acquitted. (JNF) |
