Court awards life imprisonment to LeT ultra in Udhampur blast case | | | Early Times Report
Jammu, Sept 10:Principal sessions judge, Udhampur, R S Jain today awarded life imprisonment to LeT militant Abdul Majeed of Behrote near Thanamandi in Rajouri in Udhampur bomb blast case. According to the prosecution case, Majeed and Ghulam Sarvar are LeT terrorists having links across the International Border and were involved in terrorist and disruptive activities in J&K to create terror among people, endanger the security of state and disturb the public tranquillity. With this motive, they entered into a criminal conspiracy and caused an explosion at 8.30 am at Dhanori near Birma bridge by the national highway at Udhampur on May 2, 2011, resulting in the death of one person and injuries to other persons, and damage to public property. In a Maruti car No DL3CF/8035 purchased by Abdul Majeed, Ghulam Sarvar kept RDX and detonated it with a remote control device. In the explosion, Kuldeep Kumar died on the spot and 6 others sustained grievous injuries. One army ambassador car was also damaged in the explosion. FIR No 83/2011 was registered at police station, Udhampur. On conclusion of the investigation, the IO finding the accused guilty of offence under sections 302/307/324/326/120-B RPC read with section 3 of Explosive Substance Act and Section 16/18 of Unlawful Activities (Prevention) Act presented the challan against accused Majeed and Ghulam Sarvar. Accused Ghulam Sarvar could not be arrested and proceedings under section 512 CrPc was initiated against him. The judge, after hearing the two sides, held that the offence was committed in a pre-planned manner. The mitigating factors are that the convict Abdul Majeed is not involved in any other criminal case and he is about 63 years old and if awarded life-imprisonment, would be considered, if at all, for remission of sentence, at a stage when he would have suffered incarceration for 15 years. "After having considered the submissions made before me and the various aggravating and mitigating factors, I hold that the case in hand certainly does not fall within the category of rarest of rare cases. Therefore, the court awards the following sentences to the convict under sections 120-B read with sections 302/307/326/324 RPC/section 3 of Explosive Substance Act and Section 16/18 of Unlawful Activities (Prevention) Act, is sentenced to imprisonment for life and under section 302 of RPC is sentenced to imprisonment for life and fine to the tune of Rs 25,000. Under section 16 of Unlawful Activities (Prevention) Act is sentenced to Imprisonment for Life and fine to the tune of Rs 50000. Under section 18 of Unlawful Activities (Prevention) Act is sentenced to imprisonment for 10 years and fine to the tune of Rs 5,000, under section 307 of RPC is sentenced to imprisonment for 10 years and fine to the tune of Rs 25000 and under section 326 of RPC is sentenced to imprisonment for five years and under section 324 of RPC is sentenced to imprisonment for three years and under section 3 of Explosive Substance Act is sentenced to imprisonment for ten years and fine to the tune of Rs 25000.(JNF) |
