Division Bench seeks status of Rs 44000 cr flood relief package by Oct 6
Terms relief provided to flood affected so far as 'peanuts'

SRINAGAR, Sept 10: Observing that the Rs 4000 crore provided by the Central government to the Jammu and Kashmir so far for flood relief and reconstruction was "peanuts", the Division Bench of J&K High Court comprising Chief Justice N Paul Vasathakumar and Justice B L Bhat sought status of Rs 44000 Cr flood relief package from Union Finance Ministry by Oct 6.
Hearing a Public Interest Litigation filed by two lawyers last year, a division bench of Chief Justice N Paul Vasathakumar and Justice B L Bhat also directed Supreme Court appointed panel to file damage assessment report by September 30.
"This amount Rs 4000 crores is around 9% of Rs 44000 crore package sought by the state and is peanuts. It is very low amount and the flood of such a magnitude is to be given much importance.," the division bench said.
In the status report, Ashok Shukla, Deputy Secretary in the Ministry of Home Affairs, said that Rs 44000 crore was under consideration of the Indian finance minister.
"Out of the 1667 Cr package announced in June this year by finance ministry, Rs 838 crore was announced on account of pending liabilities of the Prime Minister's Reconstruction Plan 2004, Rs 551 crore ex-gratia relief for repair or reconstruction of damaged Kaccha houses, Rs 59 cr for food subsidy and 172 crore for tourism sector," Shukla said in a status report filed through Assistant Solicitor General of India (ASGI) S A Makroo.
The ASGI also produced a letter from National Disaster Management Authority, stating that out of the PM Relief Fund, Rs 367.69 crores were released for damaged houses numbering 109258.
Meanwhile Makroo also sought time to get the "instructions" regarding the package. On this DB said that Secretary Finance Ministry being not a party in this PIL and this court is of the opinion that (it) is to be impleaded as party to get instructions regarding the sanction of further amount and directed the secretary to file status report on October 6.
It also directed state's Additional Advocate General Tasaduq Khawaja to file status report regarding utilization of the amount already sanctioned by the GoI.
"State government also is directed to file the status report regarding the amount released to the beneficiaries and any further relief to be provided to the other beneficiaries already identified."
The court also directed the registrar vigilance to expedite the process of identification of the damage to the structure as directed by the Apex Court and file the report by September 30.
